MEMORANDUM OF SETTLEMENT SIGNED AT MUMBAI ON 17TH NOVEMBER, 2017 FOR CREATION OF ADDITIONAL POST OF SINGLE WINDOW OPERATOR “B” ---------------------------------------------------------------------------------------------------------------------

Memorandum of Settlement signed at Mumbai on 17 th November, 2017 between the Management of Bank of India and the representatives of the Federation of Bank of India Staff Unions’ for creation of additional post of Single Window Operator “B” under Section 2(p) and Section 18(1) of the Industrial Disputes Act, 1947 read with Rule No. 58 of the Industrial Disputes (Central) Rules, 1957. A Memorandum of Settlement was signed between the Management of Bank of India and the Federation of Bank of India Staff Unions’ on 24 th March, 2011, under the provisions of Industrial Disputes Act, 1947 and the Rules made there under, creating 8800 (Eight thousand eight hundred) posts of Single Window Operator ‘B’ in the Bank and allocating the posts so created among istrative zones of the Bank. The Settlement also laid down broad norms for selection and assignment of duties of Single Window Operator ‘B’. 2. The Federation of Bank of India represented to the Management of the Bank to consider creation of additional posts of Single Window Operator “B” in the Bank. The parties to the aforesaid settlement, in course of discussions, reviewed the need of Single Window Operator “B” in the Bank and agreed to create additional posts of Single Window Operator ‘B’ to facilitate smooth functioning of branches. OF THE SETTLEMENTS It is agreed by and between the parties that: i)

Those Single Window Operator ‘A’ who have completed two years of service in the Bank as on 30th September, 2016 will be converted/elevated as Single Window Operator ‘B’ by 31st December, 2017. …2/-

The General Manager (HR), in consultation with the Federation of Bank of India Staff Unions’ will decide the total number of additional posts of Single Window Operator ‘B’ to be created in each istrative Zone of the Bank.

iii)

On receipt of allocated number of post, as would be decided under (ii) above, the Zonal Authority will take decision as regards the branches wherein the said post/s would be created to cater to the need.

iv)

The modalities or detailed guidelines for assignment of duties of such set of Single Window Operator ‘B’ would be discussed and finalized with the representatives of the Federation of Bank of India Staff Unions’. The modalities worked out or the Guidelines so framed will not supersede the Memorandum of understanding dated 21 st July, 2011 for selection and assignment of duties of Single Window Operator ‘B’.

v)

The need to increase the number of posts of SWO-B, if any, would be discussed /reviewed after the implementation of this Settlement.

3. This Settlement is arrived at under the Provision of Industrial Disputes Act, 1947 and the rules made there under and shall remain in force until it is mutually agreed to modify it. 4. The parties to this settlement further agree that copies of this Memorandum of Settlement shall be tly forwarded to the concerned authorities as specified in Industrial Disputes Act, 1947. 5. In case of any difficulty, doubts or disputes regarding interpretation /implementation of any of the provisions, the matter will be taken up only at the level of Head Office and Federation of Bank of India Staff Unions for resolving it mutually.
